Protect your Band Name

When trying to make the transition from local band to a national act, musicians often skip the crucial step of protecting their trademark. If you plan on reaching a global audience, neglecting to establish clear ownership of your band name can spell disaster. For example, think of what it could do to CD and merchandise sales. Imagine if you were forced to change your band name because another band established rights to that name or logo that you had thought was yours alone. Few acts would survive having to re-establish their commercial identity under a new name, or shoulder the expense of reprinting CD covers, flyers, T-shirts, and all other promotional material.

When creating a trademark or name, the key is to develop a strong connection in the mind of your audience. First, create a unique name that has little chance of being in use. Then establish the trademark over a wide geographical region by registering your name locally by filling out a fictitious business statement. Next, apply for a federal trademark through the Patent and Trademark Office in Washington, D.C. These actions require research of existing trademarks to confirm what is available. You can do this by utilizing databases and directories through libraries and the internet. You can also contract a commercial trademark search firm.

If you feel as though this process is too much to handle on your own, look into hiring a trademark lawyer or enlisting a trademark service. Be sure to shop around and get plenty of references before hiring anyone. By taking these all important steps, you may someday be able to see your band name in lights....and not have to worry about losing your rights.
